Thank you for visiting the website and/or mobile application of The Kallang. These Website and Application Terms of Use (“Terms”) govern your access to and use of this website / mobile application / any related digital platforms (collectively, the “Platform”) operated by The Kallang Group Pte Ltd (the “Company”, “we”, “us” or “our”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you should not use the Platform.

We may offer a loyalty or rewards programme (the “Programme”) to eligible users via our Platform. Participation in the Programme is optional; however, certain features, benefits, or functionalities of the Platform may only be available to users who are enrolled in or actively participating in the Programme.

To participate in the Programme, you may be required to provide certain information. You agree to provide accurate and complete information and to keep such information up to date. You are responsible for all activities conducted in connection with your participation in the Programme.

Additional terms and conditions governing the Programme (the “Programme Terms”), including our Privacy Policy, will apply and are incorporated into these Terms by reference. The Programme Terms will be made available within the Platform or via a separate link.

By enrolling in or participating in the Programme, you agree to be bound by the Programme Terms.

In the event of any inconsistency between these Terms and the Programme Terms, the Programme Terms shall prevail in relation to the Programme.

We reserve the right to modify, suspend, or terminate the Programme or any part of it at any time, subject to applicable laws.

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You shall not:

• Interfere with or disrupt the Platform;
• Attempt unauthorized access to systems or data;
• Use the Platform in a way that may harm the Company or other users, or which infringes, misappropriates or violates any person’s rights;
• Reverse assemble, reverse compile, decompile, translate or otherwise attempt to discover the source code or underlying components of models, algorithms, and systems of the Platform (except to the extent such restrictions are contrary to applicable law); or
• Manipulate, share, duplicate, or fraudulently use any QR codes, check-in mechanisms, barcode scanning features, or similar verification tools provided through the Platform.

All content, trademarks, logos, and materials (including graphics and images) on the Platform (“Content”) are owned by us or our licensors and are protected by applicable laws.

Unless otherwise provided in these Terms, you may not download, copy, derive, reproduce, republish, upload, post, transmit, modify, distribute, display, broadcast, market or exploit Content or any part thereof in any way, without prior written consent from the Company.

To seek the Company’s written consent for the foregoing, the request to the Company must be in writing, stating the Contents for use; intent of use; manner of use; time frame of use and identity of the user. We reserve the right to refuse consent without the need to provide any reason(s); and/or if information submitted by the user is deemed insufficient.

Any use of the Contents or any part thereof which does not conform with what the Company has provided prior written consent for, will be a violation of the Company’s copyright and other intellectual property rights.

This Platform contains hyperlinks to third-party websites, services and platforms that are not maintained by the Company and which may be subject to their own terms. The Company is not responsible for the contents of those third-party websites and shall not be liable for any damages or loss arising from access to those websites. Use of the hyperlinks and access to such websites are entirely at your own risk. Without limiting the foregoing, certain transactions (including ticket purchases, facility bookings, and food and beverage orders) may be completed on or through third-party platforms, and the Company shall not be liable for any loss, delay, error, or dispute arising from such transactions conducted on those platforms.

Hyperlinks to other websites are provided as a convenience to the user. In no circumstances shall the Company be considered to be associated or affiliated in whatever manner with any trade or service marks, logos, insignia or other devices used or appearing on websites to which this Platform is linked.

Except as set forth below, caching and linking to, and the framing of The Kallang Website or any of the Contents are prohibited. In particular, and notwithstanding anything to the contrary, we prohibit linking to or framing in any site containing inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topics, names, material or information, or material or information that violates any applicable intellectual property, proprietary, privacy or publicity rights.

Linking to the Homepage: You may link to the Homepage of The Kallang Website (https://www.thekallang.com.sg or any successor locations thereto), upon notifying the Company in writing via the contact details set out in Section 4 (Intellectual Property) of this Terms of Use.

Hyperlinking to an internal page of The Kallang Website: You must make a specific request for, and secure permission from the Company prior to hyperlinking to, or framing, any internal page of The Kallang Website or any of the Contents, or engaging in similar activities. The Company reserves the right to impose conditions when permitting any hyperlinking to, or framing of, any internal page of The Kallang Website or any of the Contents.

Proceeding with linking to, or framing The Kallang Website or any of the Contents (based on the Company’s permission where necessary) constitutes acceptance of these Terms. This is deemed to be the case even after the posting of any changes or modifications to these Terms of Use. If you do not accept these Terms, you must discontinue linking to, or framing of The Kallang Website or any of the Contents. If we provide permission for any such links or frames, we are not under any obligation to establish reciprocal links with third parties.

Under no circumstances shall the Company be considered to be associated or affiliated in whatever manner with any trade or service marks, logos, insignia or other devices used or appearing on third party websites that link to The Kallang Website or any of the Contents.

The Company reserves all rights to terminate your use of the Platform at any time without prior notice, and to disable any links to, or frames of any website containing inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topics, names, material or information, or material or information that violates any written law, any applicable intellectual property, proprietary, privacy or publicity rights.

The Company reserves the right to disable any unauthorised links or frames and disclaims any responsibility for the content available on any other website reached by links to or from The Kallang Website or any of the Contents.

In connection with your use of the Platform and participation in the Programme, we may collect, use, and disclose your personal data, including but not limited to your name, email address, mobile number, date of birth, residency status, location-based check-in data, music and sports preferences, facility booking history, and transaction data. The Platform is constantly undergoing development to improve the user experience. Therefore, we may modify, suspend, or discontinue any part of the Platform at any time without prior notice. 

The materials and content of our Platform are provided "as-is" and without warranties of any kind either express or implied. To the fullest extent permissible and subject and pursuant to applicable law, we disclaim all warranties, express or implied, including, but not limited to, implied warranties of satisfactory quality, merchantability and fitness for a particular purpose. We do not warrant that the functions contained in the materials or our Platform will be uninterrupted or error-free, that defects will be corrected or that our Platform or the server that makes it available is free of any virus or other harmful elements. We do not warrant or make any representations regarding the correctness, accuracy, reliability, or otherwise of the materials or content on our Platform or the results of their use.

To the fullest extent permitted by law, the Company shall not be liable for any direct, indirect, punitive, exemplary, special or consequential damages, loss of profits, and loss of enjoyment arising from your use of, or the inability to use, the Platform.

You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, agents, and partners from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of or access to the Platform; (b) your violation of the Programme Terms; (c) your violation of any applicable law or regulation; (d) your participation in any activities organised or facilitated by other users through the Platform, including any Interest/Social Matching activities under the Loyalty Programme; or (e) any content or information you submit, post, or transmit through the Platform.

We reserve the right to amend these Terms at any time. Such changes will be effective immediately upon being published on the Platform. Continued use of the Platform constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore. Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts of the Republic of Singapore.
